Terms of Service

These terms are an agreement between you and Echoes (“Echoes,” “we,” “us”) about your use of our website and app (the “Service”). By using the Service, you agree to them. If you do not agree, please do not use the Service.

1. Who can use Echoes

You must be at least 18 years old, or the age of majority where you live, to create an account or buy a subscription. You are responsible for activity on your account and for keeping your sign-in secure.

2. Your content

You keep ownership of the photos, notes, and other material you upload (“Your Content”). You give us a limited license to host, process, and display Your Content only as needed to run the Service for you — for example, to generate stories and audio and to show them to you or to people you share them with.

You confirm that you have the rights needed to upload Your Content and that it does not violate anyone else’s rights.

3. AI-generated stories and voices

• Stories, titles, tags, and narration are generated by AI. They are imaginative and may be inaccurate. They are not a record of real events or statements, and you should not rely on them as fact.
• Narration voices are synthetic. They are not the voice of any person in your photos.
• Family voice recordings are real recordings made by you or people you invite. Only record, or invite, people who agree to be recorded and shared.
• Subject to these terms, you may use the stories and audio generated for you for personal, non-commercial purposes.

4. Acceptable use

You agree not to use the Service to:

• upload content that is illegal, sexually explicit, or exploits or endangers minors;
• harass, defame, or impersonate anyone, or present generated content as a real person’s words or voice;
• upload or submit recordings of anyone without their permission;
• upload photos of other people in a way that violates their privacy or rights;
• attempt to break, overload, scrape, or reverse-engineer the Service, or bypass plan limits;
• use the Service to build a competing product or to train AI models.

We may remove content or suspend accounts that violate these terms.

5. Plans, billing, and cancellation

• Some features require a paid subscription. Prices and plan details are shown before you buy.
• Subscriptions renew automatically at the end of each billing period until you cancel.
• You can cancel any time from “Manage billing” in the app. Cancellation takes effect at the end of the current billing period, and you keep paid features until then.
• Except where required by law, payments are non-refundable. If something went wrong, contact us — we’ll make it right where we can.
• We may change prices with advance notice; changes apply from your next billing period.
• Free plans include usage limits, which may change over time.

6. Sharing

When you turn on a listen link, anyone with the link can view and hear that Echo. You are responsible for who you share links with. You can turn a link off at any time.

7. Changes and availability

We are constantly improving Echoes and may add, change, or remove features. We aim for high availability but do not guarantee the Service will always be uninterrupted or error-free.

8. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, Echoes will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or content. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You can stop using the Service and request account deletion at any time. We may suspend or terminate access if you violate these terms or if we discontinue the Service; where practical, we will give you notice and a chance to download your content.

11. Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.

12. Changes to these terms

We may update these terms. If changes are significant, we will notify you before they take effect. Continued use after that means you accept the updated terms.
